DHS Warns of Legal Consequences for Interfering with Federal Immigration Enforcement

In May 2025, the U.S. Department of Homeland Security (DHS) issued a stern warning that individuals—regardless of their position—who interfere with federal immigration enforcement operations could face legal consequences, including arrest.

This statement came in response to incidents involving unauthorized attempts to enter federal immigration facilities. DHS emphasized that such actions might be considered trespassing and obstruction of law enforcement duties, especially if they involve physical confrontation or failure to comply with official warnings.

The situation garnered significant attention following an incident at the Delaney Hall detention center in Newark, New Jersey. Newark Mayor Ras Baraka was arrested on May 9, 2025, while protesting the opening of the facility. He attempted to join a scheduled tour of the center with three members of New Jersey’s congressional delegation. Federal authorities stated that Baraka ignored repeated warnings and attempted to access a restricted area, prompting law enforcement to take action.

Subsequently, U.S. Representative LaMonica McIver was charged with two counts of assaulting federal law enforcement during the same protest. Prosecutors allege she physically interfered with Homeland Security and ICE agents. McIver, supported by House Democratic leadership, argued that the charges are politically motivated and designed to stifle congressional oversight of ICE.

DHS Assistant Secretary Tricia McLaughlin commented on the incident, stating that members of Congress are not above the law and cannot illegally break into detention facilities. She emphasized that such actions go beyond political stunts and endanger the safety of law enforcement agents and detainees.
